Advertising Disclosure in Creator Collaborations: What Brands Should Know
Why collaborations must be recognizable as advertising and what has proven itself in practice.
Collaborations with creators must be clearly recognizable as advertising for viewers. In practice, a clear notice such as "Werbung" or "Anzeige" at the very start of the content has proven itself. Brand, agency and creator clarify this together in the briefing.
Note: This article describes PANA's practice and is not legal advice. Which rules apply in a specific case is for the advertising company to clarify with its legal department.
Why disclosure is needed
Viewers should be able to tell when content is paid or otherwise compensated, for example through products, tickets or commissions. If the notice is missing, this can have consequences for the creator and the brand. That is why disclosure belongs in the briefing of every collaboration from the start.
What has proven itself in practice
- Clear term: "Werbung" or "Anzeige" in German-language content instead of vague wording.
- Early and clearly visible: The notice appears at the start of the content, not hidden at the end.
- In the content itself: For videos and stories, a notice on screen or spoken is better than only in the description.
- In every part: With several stories, each story should be labeled.
- Platform tools as a supplement: Features such as "paid partnership" do not automatically replace your own notice.
Who is responsible?
Both sides. The creator publishes the content, and the brand benefits from it. Disclosure and wording should therefore be set in the briefing and checked during approval. How such a briefing is structured is explained in the article What belongs in a creator briefing?
Stricter requirements for regulated products
For financial products and other regulated offers, further mandatory information is added. How PANA handles this in practice is shown in the article Creator marketing in regulated industries and in the case studies.
Checklist for brands
- Define disclosure in the briefing
- Specify the term and position of the notice
- Check drafts before publication
- Involve compliance early for regulated products
- When in doubt, ask the legal department
